I tested positive for throat GONORRHEA! Had an oral swap....PLEASE HELP! Worst case scenario!!!!!!!!!?

I received my test results two weeks ago, and tested negative for HIV, Syphilis, Gonorrhea and Chlamydia. However, after a week, I received a phone call from the doctor telling me that after they tested my throat, they realized I tested positive for gonorrhea throat.

OMG I was so relieved after testing negative, and now today I find this out!! :( I am soooooo scared and worried. He said to go ASAP so that it can be treated before it starts spreading in my body. I'm only 17 and tomorrow I have school.

I have a unit exam for AP Government tomorrow, but I'm thinking of leaving school after the test...I would leave early and the doctor suggested to go tomorrow b/c they close late tomorrow...4:30. I get out at 3:25 and will have to take the public bus. Do you think the school will want a note if they see me walk out from school? I'm not even sure if I can leave early from school without a parent. If they ask, should I just tell them I have a doctor's appointment and my mom can't take me? The doctor said he would give me a note...but of course that's until I get there.

The problem is....how will I leave school early tomorrow????I tested positive for throat GONORRHEA! Had an oral swap....PLEASE HELP! Worst case scenario!!!!!!!!!?
That outta learn you.

I suggest manning up, telling your parents, and asking for their help. It sounds like they need to know what kinda of girl they have for a daughter.I tested positive for throat GONORRHEA! Had an oral swap....PLEASE HELP! Worst case scenario!!!!!!!!!?
You should really tell your parents. They are going to have to pay for your surgery if you get throat cancer. You did an adult thing, grow up %26amp; become an adult!!!

Is there any sure tests to let me know if i suffered from chlamydia for 20 yrs nhs deny itprob in case i sue t

There is no way to tell how lomg you have had the infection, a test will merely say yes or no, nothing more;Is there any sure tests to let me know if i suffered from chlamydia for 20 yrs nhs deny itprob in case i sue t
I'm probably well wrong on this one, but if my memory serves me right, nobody had ever HEARD of it twenty years ago!
I am not really sure what you are asking. No, there is no way of being able to tell exactly how long someone has had chlamydia for as the disease often leads to sub-clinical symptoms (ie, there are no obvious symptoms) Chlamydia is a contributing factor to some cases of infertility and obviously the longer that someone has chlamydia, the chances of this are increased.

I would speak to someone at the local Genito-urinary medicine clinic.
Chlamydia is caused by the bacteria chlamydia trachomatis.

Much chlamydial infection goes undiagnosed, because the infection is often without symptoms (about 25% of men and 70% of women).

However, it can cause vaginal bleeding and discharge, abdominal pain, fever and inflammation of the cervix in women.

And in men, it can cause a watery or milky discharge from the penis, swollen or tender testicles and a burning feeling while urinating. It is possible that if you had taken antibiotics for some other illness, your chlamydial infection might have got cured and again reinfected from your partner.

The long term complications can be severe, especially for women where it can lead to pelvic inflammatory disease, ectopic pregnancy and infertility.

Between 20% and 50% of children born to women with chlamydia will be infected.

Chlamydia is the leading cause of neonatal conjunctivitis, an eye infection in babies that can cause blindness.

However, it is easy to treat with antibiotics.

It is possible that if you had taken antibiotics for some other illness, your chlamydial infection might have got cured and again reinfected from your partner.

Please see the web pages for more details on Chlamydia.
If the test cam ebakc negative, you don't have chlamydia. Don't be so mistrusting.
a man will show symptoms, you will know,a woman maybe not

If you get a case of endagering a child, will you get drug tested when you go to trial?

my friend really wants to know lol...If you get a case of endagering a child, will you get drug tested when you go to trial?
The cops cannot simply tackle someone for being around a known drug user, and if they did so with a baby in his arms (assuming no weapon was involved, then they are guilty of endangering the child themselves. Forget internal affairs at this stage. Get an attorney, and have all medical documentation for the injuries to your child. Do not delay. They would have to show just cause for tackling a man holding a baby, or face brutality and endangerment charges. Take action right away. Get the press involved if needed. If you get a case of endagering a child, will you get drug tested when you go to trial?
most states require a drug test for any offense in which requires processing. This helps prepare the officers for any type of medical emergency that can occur due to drug use. Most likely though the drug test can not be used against you on drug possession charges unless during the arrest drugs are uncovered. the best thing for your friend to do is ask his attorney and if he doesn't have one he needs to get one. ';A man who defends himself has a fool for a client';
Not while she is in the process of any hearings. She will get drug tested if she gets put on probation. Hopefully she doesn't get probation. I hope someone who would endanger a child gets serious prison time. But since i know the system i know the deal. She won't get squat.
I dont believe that the court can make you provide a drug test for the charge because they lack probable cause. but they might make you submit a drug test to get your kids back! JUST DONT DO DRUGS YOU IDIOT AND YOU PROBABLY WOULDNT BE IN THE POSITION YOU ARE IN... GREAT ROLE MODEL FOR YOUR KIDS
';your friend'; ;-) will be tested until you are found innocent or guilty.

I have a very serious case of sleep apnea. I have gone thru 5 overnight tests?

After those 5 sleep studies Dr. Bond told me that I was untrearable. He had used MANY different masks, also using oxygen. I was told the average person with apnea stops breathing somewhere between 5 to 15 per hour. On my first test that number was 69, and has varied between 55 to 75 thru those 5 tests. DOES ANYONE KNOW OF A HIGHLY REGARDED SPECIALIST ON APNEA somewhere relatively close to Williamsburg, VA. My doctor, Thompson Bond, is well qualified, but I'm desperate to be able to get some sleep at night. If the present pattern holds, I probably won't last the year out. THAT'S DESPERATE.

Dick Milhizer // rmilhizer@cox.netI have a very serious case of sleep apnea. I have gone thru 5 overnight tests?
It sounds like you may have central apnea versus the more common obstructive apnea. Central sleep apnea usually occurs in people who are seriously ill. For example, it can occur in people with a variety of severe and life-threatening lower brain stem lesions. The brainstem controls breathing. As a result, any disease or injury affecting this area may result in problems with normal breathing during sleep or when awake.

Conditions that can cause central sleep apnea include:

Bulbar poliomyelitis

Encephalitis affecting the brainstem

Neurodegenerative illnesses

Stroke affecting the brainstem

Other causes include complications of cervical spine surgery, secondary radiation in the region of the cervical spine, severe arthritis and degenerative changes in the cervical spine or the base of the skull, or primary hypoventilation syndrome.

There is a form of central sleep apnea that commonly occurs in people with congestive heart failure. Finally, idiopathic central sleep apnea is when the apnea is not associated with another disease.

If you are not seeing a pulmonary specialist, then do so immediately. If you are seeing a pulmonary specialist, perhaps a referral to a neurologist would be another option. Don't give up. There is an underlying cause, but it is going to take a concerted effort to locate it.

He isn't in your area, but perhaps you could contact Dr. Daniel J Gottlieb (Boston University) He is an expert in sleep apnea and is a pulmonologist. Perhaps he could consult on your case. Just a thought. Good luck.I have a very serious case of sleep apnea. I have gone thru 5 overnight tests?
I would get further care at a teaching hospital, such as UV. They will have a sleep disorders clinic and will be up on all the latest tricks to treat your apnea.
-As i know, a patient with sleep apnea will have many complications on

cardio-vascular, kidney, metabolic, psychology if he has no treatment.

-What your doctor has done for you is right, but the indication for using masks under ventilation positive pressure continuous is 30 stop breathing/ hour.

-if you can read French, search web site of AFVP.apne'e de sommeil (SAOS)

-Discussing with your doctor maybe the good resolution

Missing period but pregnancy tests are negative !!! what are the possibilities ? what can be the case?

Depending on your age, your period can fluctuate quite a bit, there can also be other causes including stress, heavy activity, hormone imbalances, and many endometrial issues that can halt a period or cause it to be late. The younger you are the less likely your period will be reglar, even if it has been regular before.

Call your gynecologist for a blood test and a full work up, it is the only way to get a real answer...Missing period but pregnancy tests are negative !!! what are the possibilities ? what can be the case?
It's possible to just be having a missed period.. it happens, especially depending on how you are. If it keeps coming up negative, and you really are worried about being pregnant with a missed period, just go to your doctor. There is a chance you are taking a test too early. Sometimes the hormones just aren't high enough to show up on a HPT.

Try to relax. Because you being stressed may cause the period to be delayed even longer.

  • IF BLOOD IS TAKEN FROM YOUR HAND AND TESTED in court DUI case would it read the same blood alcohal content as

If blood was taken from your hand and tested for its blood alchol content would it read the same as if it was taken and tested from your arm?????????????IF BLOOD IS TAKEN FROM YOUR HAND AND TESTED in court DUI case would it read the same blood alcohal content as
Blood runs all thru your body........duh.

    Same blood. Yup.

You can take it from your a** for all I care. The reading will be the same.

You're busted.IF BLOOD IS TAKEN FROM YOUR HAND AND TESTED in court DUI case would it read the same blood alcohal content as
Yes it would...the blood in your hand is exactly the same as the blood in your arm due to circulation, therefore the alcohol content would be the same.
    yep.
I would think that they taken a DUI/DWI deal with the benefactor of a breathalizer, I would use your judgement.
No it would come out the same. But make sure that they did not use a alcohol swab or alcohol to disinfect the area or the test may come out higher, that alcohol will get on the needle and make for a higher reading so make sure they used iodine. But the answer is no it's the same outcome.
absolutely any time they take a BAC% from your blood sample then it will be accurate even if it was taken from your foot hence the meaning blood alcohol content percentage which means that your blood has a certain percent of alcohol in it when flowing through your viens and since your blood pumps at such a good rate of speed through your entire body you can get the same amount from the hand arm foot butt anywhere the only other thing that will affect it is time from which samples are taken

After taking the MAP & in case it has not worked when is the best time to do a preg test?

as it is known to delay your period? After taking the MAP %26amp; in case it has not worked when is the best time to do a preg test?
Haha, ive been through exactly the same thing! Take your test the day your period should start (i know, the wait in suspence can kill you!), and do it in the morning, as it gives a better test result.

    Good luck!

Hair testing for drugs in custody case?

My friend has a three month old daughter and is trying to get full custody from her ex, who she left because he was an alcoholic and smoked pot. She is freaking out bc he coerced her to take ecstasy one time and thinks he might try to get the court to take a hair sample to prove it. Her ex has always buzzed his hair so he doesn't have to worry. She took it about four months before she was pregnant but wants to cut her hair really short before their next court date so he can't do that.

I told her I don't think they would take her hair but I don't know. Should she cut her hair?Hair testing for drugs in custody case?
Even if he buzzes his hair they will find hair somewhere in the body, legs, ***, arms, anything. Trust me my ex shaved his head but they still found other hair they can use.Hair testing for drugs in custody case?
Usually they won't do something that drastic unless the other party is going to pay for it. If her ex isn't willing to fork out that money, they won't do the test. On top of that, the majority of the time, they only go back a certain amount of time (usually 3-6 months). I wouldn't go as far as to cut all my hair off because it isn't likely that they will do a hair test and even if they do, they won't go back as far as when she did it.
tHAT IS TO LONG AGO THAT WON'T BE IN HER SYSTEM ANYMORE..DON'T WORRY
Now you know why Brittany Spears was hairless, top and bottom, for a while. But if you are going to try to defeat the hair test, you have to remove every bit of hair from the body.

The test only shows drugs taken into the body while the specific hair was growing. Unless your friend has really long hair, what she took more than a year ago, ( 4 months before preg ) isn't going to matter.
don't worry extacy only stays in her system for a few days...shell be ok..
I wouldn't worry about a drug test for this. Even if they did a hair test it would show when she took it.

Even if he shaves his head i promise he has hair other places they could us.

Don't bother with a hair cut if its really been a year. They don't normally do a hair drug test. and as I said, they do his also.

The answer is yes he can request a hair folicle test if he can raise suspision in the courts eye. However, most hair folicle tests only go back 120-180 days. And shaving your head wont do any good. Because the can take hair samples from anywhere on your body. nose eyelash eyebrow ear pubic aor armpit. Cutting hair will not only raise suspision but look bad as well. Tell her to hang tight. And if shes doing dope then she deserves to lose custody. Not so much she deserves to lose custody but that baby deserves better. Short of that her husband has to prove her unfit to raise a child to really have any kind of case.

So today i got tested for the flu.. is my case more serious?

so i went to the doctor today and got tested for flu, it was positive, and my doctor told me it's most likely the swine flu, but i'm getting worried because i get dizzy and i when my room was 76 degrees i was freezing, shivering, goosebumps, had a jacket, etc, and then about 30 min later i was feeling really hot, my rooms still 76 degrees, i changed into shorts(i had sweatpants on) and took my jacket off, and put my fan on high, and i'm still really hot. also when i breathe through my nose i can feel like warm air coming out. by the way i'm 13 years old.So today i got tested for the flu.. is my case more serious?
Normal.Actually very mild compared to when I had the normal flu once.So today i got tested for the flu.. is my case more serious?
You are just as normal as everyone else. Everyone gets these symptoms with the flu, you dont have anything to worry about :) Just get plenty of rest, drink a lot of fluids, and eat healthy foods, i recommend toast. Just take good care of yourself really, it will pass. (nyquil wouldnt hurt either)

And about it being swine flu, dont worry. Its only serious for those that are extremely elderly, or extremely young (like 1 year olds). The sick, like people with an already existing disease, will be more vulnerable. But you should be just fine :) It will pass eventually.
those are all normal symptoms of being sick and of the flu.

If your case was super serious you'd be unbale to breath, coughing up tons of mucus in bed dying, like in the 1918 flu. Of course that's not happening to you, so no.

I told her I don't think they would take her hair but I don't know. Should she cut her hair?Hair testing for drugs in custody case?
Exctasy does'nt migrate down the hair like opiates. So it will only be in the segment that was formed in the follicle the day after she took the drugs. If it was four months ago she would have to cut her hair prety short but definitely not buzzed. She could leave like 2-6 inches depending on how fast her hair grows. They usually get reative and pull hairs from somewhere on the body to avoid sample tampering as some products can be applied to the hair that mess up the tests. People usually don't think to apply these products to there arm hair or pubics and in my experience testers take hairs from obscure regions.

I SERIOUSLY doubt that she will be drug tested with a hari test in this situation. They are very expensive and no family ourt would ever order this. Maybe her ex could bring it up in his case and use her refusal as evidence in his favor but she should just ask him to pay for it and if he will she should since one use probably( 1 in like 200 chance) will not show up anyway. He will not pay though they cost like $500-$1000 for anyone good enough to even possibly detect a single use. Don't cut your hair BABE!!!!!Hair testing for drugs in custody case?
If she is forced to take a drug test, she can force him to take a drug test as well. They can use hair from any part of your body, so the hair on your head isn't as important as you may think. Also, they go by percentages when it comes to drug use in certain cases, so if she only did it once and he has done it several times, that will show up in the tests.
The court can force her to provide a hair sample for drug testing if they deem it appropriate, she can request that he provide one as well. They don't just take the hair on people's heads, if no hair samples can be taken from the head they will take them from the pubic region. If she purposefully tries to screw with the test by shaving off her hair, it will work against her in court. Alcohol is the only thing that really stays detectable for the lifetime of the hair. Amphetimines are detectable in the hair for about 90 days, LCD for only about 3 days, weed about 90 days, PCP about 90 days etc. I'm not exactly sure about ecstasy but I believe ecstasy is a form of amphetimine, so as long as she hasn't used it within the last 3 months (I should hope not considering her daughter is 3 months old) then she should be ok.

  • Can hair follical testing be done in a divorce case concerning custody?

my wife has smoked pot in the last month and i need to know the best test to ask for her to take to prove that she is smoking pot what is the best test? Can hair follical testing be done in a divorce case concerning custody?
You need to discuss all this with your lawyer. He needs all the info on what is going on with her. If the custody depends on her drug use yes it can be done. Usually for pot the pee test is the best but has to be done with a day or 2 after smoking it....Can hair follical testing be done in a divorce case concerning custody?
check with your attorney about this he will advise you I AM SURE

    THANK YOU
Do you even care about your kids or is it all about winning against your wife? I guess you've never done anything questionable that she knows about? You will have to explain your behavior to your kids one day--and all the brainwashing in the world won't make them happy to not have a mother. Or maybe you've already replaced her? I really hope you have better reasons for wanting custody than this.
From experiance YES they can do that. Hair follical is the best way to tell.
I'm not sure that you can force a hair follicle test on someone. Check with your state laws. The most common test is the urine test. Many employers do this and also check for 'cleansers'. That checks for certain herbs and drugs that are meant to mask THC in the urine. Some employers consider this a positive test result. You'll have to check with state laws on this again. Even if a judge wouldn't convict someone of drug abuse based on evidence of them taking something to mask the active ingredient in marijuana, they may take that into account when determining custody. Check with your attorney.
HAIR FOLLICAL TESTING CAN BE DONE- IF SHE PASSES YOU WOULD BE REQUIRED TO PAY FOR TEST. WHICH IS VERY EXPANSIVE- THEY WOULD PROBALY REQUIRE HER TO DO A URINE TEST FIRST- REASON IS THEY ARE MORE INTERESTED ON WHAT SHE IS DOING CURRENTLY. IF SHE IS GOING THRU CHILD CUSTODY HEARING AND VERY RECENTLY SMOKED POT- THAT WOULD BE BE CONSIDERED AN ADDICT

Why is the DNA from the Anna Nicole case being sent to Ohio to be tested??

DNA, in high profile cases, is often sent to 2 or 3 different places for analysis to insure that all results are exact. Why is the DNA from the Anna Nicole case being sent to Ohio to be tested??
Great facility for testing best in the world, Maury uses it. The lawyers agreed on the sight.

This should be a Maury Povich show, can see it now, Howard you are NOT the Father! Why is the DNA from the Anna Nicole case being sent to Ohio to be tested??
Because expensive lawyers are really good at confounding the fact that your abuse of Oxycodone pills (lab made heroin for rich people like Rush Limbaugh and Anna) led to your son's drug addiction and death, and ultimately played a role your own. The vultures picking over Anna's bones apparently don't want certain things to get out, and Bahamas officials are easy to pay off. My guess is that someone has paid someone off for favorable results OR Ohio is actually a more legit lab compared with whatever they have in the Bahamas.

This whole thing is shady. America's whore, the men who loved her money, and her junkie son are apparently more important than Iraq, Iran, and Afghanistan.
According to the news, The guy who's doing it is the best there is and he and his facilities are in Ohio.

Does the court send an actual ';physical order'; to the respondent in a paternity case for DNA testing?

My ex petitioned me for paternity and support through the department of economic security. I got a petition stating that both of us should get dna testing but it said nothing about dates, deadlines, and there was no ';court'; order. I have 20 days in my state to respond with a response to whether i agree or disagree with the petition. I filed my response a couple of days ago but I have never received an order directly from the court demanding i go for DNA testing. My ex texted me saying that if I have not gone for DNA testing yet that there is a warrant out for my arrest. Is this true or does the court have to actually mail me an order telling me I have to appear for dna testing, where to appear, and by what date? I would think that the court wouldn't even send out an order until after my 20 day response period? How does that all work? Do they mail me a court order now that I have responded or was there some time line I am totally unaware of?

I live in Arizona, Maricopa County.Does the court send an actual ';physical order'; to the respondent in a paternity case for DNA testing?
    The Arizona Statute

25-807. Precedence of maternity and paternity proceedings; delay for blood or tissue tests; court order; evidentiary use; alternative tests

    A. Proceedings to establish maternity and paternity shall have precedence over other civil proceedings. The case shall be set for trial within sixty days from the filing of an answer or oral denial by the defendant.

    B. A delay in determining paternity in an action commenced prior to the birth of the child shall be granted until after the birth of the child for purposes of paternity tests if any party to the proceedings requests.

    C. The court, on its own motion, or on motion of any party to the proceedings, shall order the mother, her child or children and the alleged father to submit to the drawing of blood samples or the taking of deoxyribonucleic acid probe samples, or both, and shall direct that inherited characteristics, including but not limited to blood and tissue type, be determined by appropriate testing procedures. An expert duly qualified as an examiner of genetic markers shall be agreed upon by the parties or appointed by the court to analyze and interpret the results and report to the court.

    D. If the results of the blood tests indicate that the likelihood of the alleged father's paternity is ninety-five per cent or greater, the alleged father is presumed to be the parent of the child and the party opposing the establishment of the alleged father's paternity shall establish by clear and convincing evidence that the alleged father is not the father of the child.

    E. The examiner's report shall be admitted at trial unless a timely written challenge to the examiner's report is filed with the court within twenty-one days of the initial trial date. If the results of the examiner's report have been challenged and on the reasonable request of a party, the court shall order an additional test to be made by the same laboratory or an independent laboratory at the expense of the party requesting additional testing.

    F. If a timely written challenge is not filed pursuant to subsection E, the examiner's report is admissible in evidence without the need for foundation testimony or other proof of authenticity or accuracy.

    G. The court shall, on application of either party, determine the proportion and time in which the initial test costs shall be paid.

    H. On motion of a party to the proceedings, the court may order that experts perform alternative or additional tests including medical, scientific and genetic tests.~

Yes, but the level will test higher since you have to wait a while after getting arrested to have your blood drawn.

    I believe so.
Yes. It doesn't matter where they take the blood from, it will all have the same alcohol levels.
    daaaaaaaaaaaaaaaaaaaaaaaaaaaa. i cant believe it
no because by the time you get to court your not drunk anymore and the alcohol will have had time to leave your body
The blood levels will be the same throughout the body with the exception of oxygen/carbon dioxide content from veins versus arteries or with finger stick blood collection which will contain more tissue fluid reducing the hematocrit just slightly.
Yes. It's all the same blood in your system.
Yes, it is the same, your veins are all connected. Don't drink and drive.

Ok, what about looking at something in organizational psych? You could do a case study on vocational assessments, or psychological screening of potential employees. It's a fun area to do :D

Or you could do it on the psych testing of early childhood autism. Check out the Flinders University Early Intervention Research Program as they have published quite a lot of data about their studies :DCase study for psych testing?
The economy is on everyone's mind. People are losing their jobs and life savings as the stock market and real estate home values drop. Why not do a study that compares success and wealth of 2 years ago to something right now and the depths of depression and/or anger people feel. You could actually ask people on myspace of facebook for answers too if you wanted a quick anonymous source.

Under the CPS code of practise: Code tests, why would a case be discontinued?

Each year the CPS discontinue over 150,000 cases. In 1992 it was over 190,000. As a result in 1994 the Director of Public Prosecutions issued a revised Code of Practice which outlined when a prosecution should go ahead - this involved 2 tests.

    Evidence test

    The CPS should ask themselves:

    * Is the evidence admissable?

    * Was it obtained without breaching the rules of the Police And Criminal Evidence Act?

    * Will a witness's background weaken the case?

    * Is identification evidence strong?

    * Is a magistrate/jury more likely than not to convict?

Public interest test (see Appendix A below)

This involves wide ranging considerations and is more controversial. The Code of Practice suggests factors for and against prosecution but the factors that will apply depend on the facts of every case.

Effect of the revised Code of Practice

The number of cases discontinued has decreased. But, perhaps the police are making better, initial, decisions on whether to charge or not and so are not charging where there is doubt about the evidence.

In serious crimes where the CPS discontinued cases victims have brought private prosecutions and are sometimes successful. The CPS is also criticised for reducing a charge to a less serious crime so the defendant will pleasd guilty and a conviction is assured. Unfortunately, the sentence will also be reduced which can leave the victim feeling that justice has not been done.

Sometimes when the CPS refuse to prosecute the victim sues the suspect in a civil court where the standard of proof is not as high as in criminal cases (like the case of OJ Simpson in America). It will not result in a custodial sentence but a suspect will be found responsible in law for the criminal conduct and most likely will have to pay damages to the victim.

    The Glidewell Report 1998

Sir Iain Glidewell was asked to conduct an inquiry into the Service. One of the reasons being the large number of judge ordered acquittals as a result of something being wrong with the preparation of the case.

The organisation of the CPS was criticised as being too bureaucratic and over centralised. As a result a reorganisation took place as outlined in the diagram above.

    Narey Report

This was into the delay in the criminal justice system. It suggested that CPS staff should work in police stations to prevent delay in cases being passed to the CPS. It was impractical to have a CPS lawyer in every police station and so they were assigned to criminal justice units/administrative support units. Pilot schemes were successful - they decreased delay and created better working practices between the police and the CPS. Fewer cases were discontinued (i.e. 7% in the pilot, 12% nationally). Mainly this reduction was due to CPS staff being able to advise police at an early stage in the case.Under the CPS code of practise: Code tests, why would a case be discontinued?
May be not enough evidence. The CPS will not carry on with a case if there is no chance of a realistic conviction. (www.cps.gov.uk) try this web site if in uk and it will give you all of what you want to knowUnder the CPS code of practise: Code tests, why would a case be discontinued?
mainly no realistic prospect of conviction or not in the public interest

The same code is generally followed by other prosecuting bodies such as Local Councils

Usuaaly the IT companies do manual testing, in which case they will go for Automation?(ie) why Automation?

Automation is not a replacement for manual testing, more an aid and addition to it. Testing is normally the ';bottleneck'; of software development, and so to help make testers work more efficiently, automation can be used.

Automation is more expensive than pure manual testing, but in the long term can be more cost-effective. Programmers can have a higher output if the turnaround for testing is short, and sometimes conducting an entire manual retest for a small patch can be sped up using automation.

I am looking for current books on ';Software Use Case Testing';?

Currently I found no books on Use Case testing but this site may be useful talking about designing softwares

Will a case be dismissed if the chain of custody was not signed on day the evidence was taken out to be tested?

It was taken from the evidence room but the chain of custody form was not signed.and the lab report was signed and datedWill a case be dismissed if the chain of custody was not signed on day the evidence was taken out to be tested?
More than likely, yes, as it can/could be proven that the evidence was tampered with.

  • Paternity Testing case was dismissed?

My fiance was requested to take a paternity test back on October of 2008 by his x-wife we just received a letter in the mail today stating that the ';Case was dismissed, due to the other party not showing up'; She lived in Florida and the letter also said that the state was unable to contact her and that's why the case was dismissed...

Now my question is...Can she come back on him again for another test later in the future? She was the one who requested the test and she was the one who never showed up...If the case was dismissed I don't see how she can try to do it again...Can someone with answers PLEASE give me some information about this...Thanks!!!Paternity Testing case was dismissed?
follow up with your attorney for a real answer.Paternity Testing case was dismissed?
She can but she will have to pay for every thing and have a good reason why she wants it now

Has there been a case a human got hurt because the product wasn't animal tested?

I am doing a debate on animal testing for cosmetics and I wanted to be against it but our teacher switched it up so I need a case where a person lose of hair or got a rash because a product wasn't tested on animalsHas there been a case a human got hurt because the product wasn't animal tested?
Lots of products were harmful before the government enacted the Food Drug and Cosmetics Act of 1938.

This law required that manufacturers show that their products were safe for people to use and not toxic when applied to their bodies.

I don't know of any specific cases cited of cosmetics that harmed people before the Act (but I'm sure there were some) but there were definitely tragic cases of medicines that were not thoroughly tested in animals, especially pregnant ones, before they were given to humans.

One thing you should know is that even though many cosmetics nowadays are not tested on animals in their final product form, most of the ingredients or chemicals in them have been tested on animals, either now or in the past.

Idk if im preg or not shld i stp smoking jst n case & whn is the earliest u can take a preg test?

I have always been told that when you get pregnant you should stop smoking for the baby's sake. I haven't had to worry about being pregnant till a couple weeks ago...he didn't pull out in time and i think i might be pregnant but it's still too soon to be able to take a test and find out. Should i stop smoking just in case? and when is the earliest you can take a preg test. I have irregular periods so it is normal for me to skip a period so how do i know if i skipped it b/c i was preg?Idk if im preg or not shld i stp smoking jst n case %26amp; whn is the earliest u can take a preg test?
Hmm, if it was a couple weeks ago, I'd probally buy one of the 3pack bonus tests and test in a couple weeks so enough of the HGC hormones have built up to read a positive pregnancy. It wouldnt hurt to stop smoking. I had no idea I was pregnant and was smoking for nearly 3 weeks before my doctor told me I was (My home tests kept getting invaild readings)

And after that, I had complications during my first trimester.Idk if im preg or not shld i stp smoking jst n case %26amp; whn is the earliest u can take a preg test?
yea you probably should stop smokin just in case hope this helped
You should quit just in case, not because smoking is bad for you like most will say but for the sake of the possible baby. The chemicals will take some time to clear your body. You can take an EPT about 5 days before your expected period but because you are not regular it will be a guess so make the best one you can and after a month you may want to consider taking the test again or seeing the doc just to make sure one way or the other.
Stop smoking even if you aren't pregnant. Smoking increases your miscarriage rate, low birthweight, and SIDS. Or do it out of vanity. My friends in their late twenties and early thirties who have smoked since their teens all have wrinkles, look older, and have stained teeth. It's just downright unattractive. There are also few things in life more horrifying than seeing an obviously pregnant woman puffing away. Quit now.
You should STOP smoking in general.

Especially if you are ';possibly'; pregnant

Smoking Kills- and if you do stop smoking just because you are pregnant- Just stop smoking for life.

You would want to live to see your baby grow

and not be on your deathbed by the time it graduates highschool.

So- Smoking w/ a baby on the way = NO!!

    Smoking in General = NOOOO

Live- Be happy- do you seriously need an extra ';but'; in your life??
maybe now is as good a time as any to quit?? It is definately healthier for pregnancy if you don't smoke...It is probably a bit early to do a home pregnancy test.. U can get early detections kits and if it comes back negative, i would advise doing another in a week or so to double check..
Either way smoking is bad for your health. If you plan on having children you should stop smoking before getting pregnant, rather then when you do. There is a test out now, i can't remember the name, but it can be used anytime. the only way too know if you are pregnant for sure is to get tested.
with everything we know about how smoke affects you and the people around you....why would you even question stopping?

imagine what it could do to a developing fetus.

you owe it to your child and yourself to make sure you give it the best chance at life........even if you aren't sure that you are pregnant.
Umm u should stop smoking even if u arent pregnent... smoking is never good. its better to stop early or better still dont start :)
YES!! you can take the test almost 5 days before your next period, but you can get a false reading nothing is certain with home tests. But I would quit smoking if you are concerned.

Judge orders britny spears drug testing / treatment cusody case?

would britney be less qualified as a mother for custody if she suffered from any other disease / health condition ?

how can a judge order her to test or treat anything ?

let's say a person has cancer. are they forced to go for treatment ? in order to retain their parental rights.

i do not agree with what the press has shown of her mothering skills, but , the father does not seem ideal either. the fact that he has previous kids and didn't fight for custody makes me curious as to why he wants these kids. assume it must be about money or anger. what happens when he gets tired of the kids.Judge orders britny spears drug testing / treatment cusody case?
drug and alcohol abuse is a choice. You choose to take that first hit or that first drink, and you continue to choose to do so until you are addicted and lack the rational ability and strength and desire to choose to stop.

That is the difference. Most people with other ';health issues'; as you stated, do not choose to have them.

And consider the alternative. What if the judge did nothing, and gave the children to her (or anyone else in a situation like this) and something happened to the children as a direct result of the addiction issues.

    What would people be saying then? ';why didn't the judge do something to protect those children?';

The judge is doing the best he can under the circumstances. His job is to make decisions within the framework of the law to act in the interest of the children.

Of course, I'm sure there is more to Ms. Spears than we see in the tabloids, and I'm sure she loves her children.

But she needs to love them enough to change and do what is in their best interest.Judge orders britny spears drug testing / treatment cusody case?
Because it is a law, a judge can order you to do anything if you violate the law, drinking and driving, and doing drugs, (which might shock you), is against the law....When you break the law a judge can order you to do community service....Of course you do not have to do it... but you can be charged again and go to jail......

When someone has cancer he or she hasnt broken the law..thus a judge cannot order treatment..I think your confused as to what Britney is charged with.
Well, there is an issue of child safety involved her if Britney is using drugs and watching her children. Drug abuse and suffering from cancer are very differently viewed. A judge can order her to be drug tested especially since this is a case that has been already looked into by child protective services, hence, the driving with the baby on her lap incident.

As for the father, his motives aren't at issue here. At this point, he is clean, sober, and therefore the ';better'; parent. In my opinion, neither person is a stellar parent, however, that is not the state or the court's concern. The major motive at this point is, as it should be, the safety and well-being of the children.
They are technically not forcing Britney to do anything , but they did give her an option that if she doesn't straighten up and fly right - she doesn't get her kids . I don't believe the media played that big a role as you are suggesting however { at least I don't want to believe that } because if the media did then I think it can be agreed the court system is nothing be a farce .
Yes a judge can order to see treatment and testing for a drug and alcohol problem. Having cancer is different. That is something that a person cannot control and does not endanger their children. Whereas when somebody is using drugs and alcohol, their behavior is often erratic and they are unable to care for their children properly.

Kevin Federline may not have requested custody of his two children from a previous relationship b/c their mother is able to appropriately care for them. Why would he want to disrupt their environment for no reason? That would not be in the best interest of the children. In fact he has shared custody of his other kids, but he does not subject them to the paparazzi. So at least he is showing that he is caring for them and protecting them from that media circus, when clearly it would be in his better personal interest to show them off and show what a ';good';father he is.

Neither of them may be great parents, but I doubt he is as bad as her. it is pretty evident by her past behavior that she has been using drugs pretty frequently and is not worried about the effect this is having on her children. She is totally egotistical and self serving and as long as her children are not being exploited, I lvoe watching her crazy antics!
look the girl could care less about the kids she would rather drink then be with them...she didn;t even show up to court to fight for the custody of them goes to show how much she cares...and i think kevin is just doing it for the money and the publicity i don't think he deserves those children either
I don't think either one of the are fit to raise those kids...They both party too much.
i dont get the question but i think if someone has a dieease it costs money and they think about the money when dealing with kids o.O
Brit only has to listen to the judge if she wants her kids back. As for mothering skills, she has not a clue. The kids will be MUCH better off with K-fed
The real question should be-- considering all the money Britney has, why doesn't she have better lawyers?

I applied for a position as a case worker. How do I study for the Civil Service Test?

I need this job!!! I'm located in the central New Jersey area. I have already interviewed with the board of social services and they are just waiting to receive my background check to clear that. Also, I must score within the top three applicants for the position. The job is a ft social work position that pays very well and I actually would like to go back to school (perhaps get a MSW). I wanted to know if this job would actually assist me in my plans to go back to school? Btw, I am a recent college grad and I would love to know anything about social work since this job is a social services position.

My job primarily would be dealing with the working poor, homeless and financially unstable families/single mothers, etc.

The responsibilities include: aiding them with money or government funds, welfare, food stamps, etc. Great hours and very good pay. If any social workers are out there, message me!I applied for a position as a case worker. How do I study for the Civil Service Test?
You don't indicate what your BA degree is in. If you have a BSW you will be well prepared for the exam (if NOT - you will be at a significant disadvantage. To study you might get a social work practice text - and a casework text specifically.

Some social service agencies will help employees go back and get their MSW (usually in the form of paypack). You can check with the agency directly.

I had heard that an HSG test was not painful.....well in my case it was very very painful....?

only when he was introducing the liquid though........it was pinful to the point that I had to tell the doctor to stop cause I couldn't handle it. Was that normal.......?I had heard that an HSG test was not painful.....well in my case it was very very painful....?
There are many people who are, in fact, very sensitive to the radiopaque dye that is used to visualize the fallopian tubes. A similar dye is also used with other radiological procedures. Again, not everyone has the experience that you did, but it's certainly not uncommon and they should have prepared you a little more for that possibility. I guess the thing to keep in mind is that an HSG is a great diagnostic tool in helping to identify or rule out problems so hopefully you've gotten some helpful information despite the discomfort. Take care.I had heard that an HSG test was not painful.....well in my case it was very very painful....?
I have heard its almost always uncomfortable, and you should have been warned!! At least you don't have to do it again!!

  • Will the case be dismissed with no sobriety test done?

I was arrested for public intoxication three weeks ago, I did drink that night, but I had tons of water, and I was NOT drunk, I was taking a walk after me and my mother came home and had a little fight, my foot had caught a pothole in the driveway next to the gas station, and I had twisted my ankle. The cop had seen me after that, so I kept walking. He asked me if I was ok I told him I was fine I had twisted my ankle, He asked me if I needed an ambulance and I refused, told him that I have alot of med bills to pay, I would take care of it when I got home, he asked me if I had been drinking I said I had a few shots 5 hours ago but I had been drinking water during and after. He had offered me a ride home after that I refused that too because our landlords in our trailer park have made it abundantly clear that no police are allowed in our park unless it was a dire emergency, and I did not want to risk my mother getting evicted once again. He then told me that he either takes me home or I get arrested for public intoxication, I told him again that I did not want to risk my mother getting in trouble, he then handcuffed me and took me to jail....I was not drunnk, he only went by the alcohol on my breath did not do a sobriety test of any kind, and he saw me staggering, which honestly I waslimping with my twisted ankle, I'm planning to say not guilty, I'm wondering if I even have a chance for this to be dismissed if I told the udge exactly what i told you allWill the case be dismissed with no sobriety test done?
it may be thrown out, but technicall you were intoxicated. you DID still have alcohol in you, and admitted to drinking, and unfortunatly public intoxication or DUI are NOT reqired to have a blood or breath test, because those charges do not need an alcohol limit. they are based on your brain being affected by ANYTHING including booze, drugs, medicine etc. the only charge that you need to take a test for is driving over the limit. GOOD NEWS: you explain your story to the judge and I think he will throw it out. Will the case be dismissed with no sobriety test done?
Why not?! Never plead guilty to something you didnt do. Thats what the system is for. Whats the worst that could happen? Im pretty sure if your even found guilty for an A.I., the little time you spent in jail would cover that, plus a fine. Just plead your case and see what happens. Let the judge hear it.
They do not need your alcohol level for public intoxication. You admitted to be drinking and you were staggering around maybe it was because of your ankle, but you refused medical help. Plus he probably smelled alcohol on you. Just be smart about it
Plead not guilty and tell them about your twisted ankle.

They have to prove you were intoxicated and I don't know how they can do that without a breathalyzer test. Sounds to me like this will be thrown out. Also get a public defender and get the case canceled until a later date. Never go into court without a lawyer.

Is there a documented case, where one tested positive for herpes, due to what remedy, then tested negative?

No. There is currently no cure for herpes, it stays in your body for life. It is difficult to diagnose herpes unless you have physical symptoms present, so you may find that from time to time your test results come back negative but it absolutely doesn't mean that you no longer have the virus, just that you are not experience symptoms or viral shedding at that point in time.

I was diagnosed with herpes type I and a few months later a second test came back negative - however I am well aware that I still have the virus and the subsequent outbreaks confirm it.

Until such time as the medical %26amp; pharmaceutical professions find a cure, do not ever kid yourself that you have rid yourself of the virus. It is there for life.

    Harmony

http://www.harmonyonline.com.auIs there a documented case, where one tested positive for herpes, due to what remedy, then tested negative?
what you should know is, herpes is a virus... it can be resolved by your immune system or even by an antiviral medicine..... normally will happen in months... meaning after the first detection of positive, re-test in 3 months time....

Is there a case to be made for people in high office to regularly have emotional and psychological tests?

There are so many occasions when people weilding considerable power and responsibility find, after a lifetime of faithful service, that the top job is too much for them. In particular, submissive types so often crack when having no one to tell them what to do. Should a regular visit to the psychiatrist and publication to the responsible bodies of an audit of their mental state not be obligatory? Or is being nuts necessary to get to the top?

    Re: Chief Constable of M/C

    Governor of NY

and many more !!Is there a case to be made for people in high office to regularly have emotional and psychological tests?
I don't know about people in high office but I truly believe that people who are in law enforcement should have to undergo regular emotional and psychological tests. They are the truly dangerous ones.Is there a case to be made for people in high office to regularly have emotional and psychological tests?
Not sure of the saying but i think it goes somthing like

    Absolute power corrupts absolutely

So yes i think it would be a good idea
Funny enough i was only thinking this the other day.Like has nobody noticed we are governed by people that act like they should be in an asylum
yea...like my dad who wanted to become a psychologist but instead went to med school always says ';it takes a crazy person to deal with crazy people'; when hes talking about my uncle who is a psychologist
Honesty tests would be more appropriate to most of them

Please help,,,, I have court tomorrow for a divorce/custody case , just found out drug test results @ 4:45pm?

Im in a divorce/custody dispute, and have court tomorrow.. im the mom and got my rights taken away temporarily

because @ my court date their father said i was an addict, which ive in the mean time gone to psychologists, and counselors to determine that i am not an addict, i have been injured in 2 car accidents and have a physical dependancy to 2 certain mind altering prescriptions that im in the process of weening off of to my own free will. The judge never ';ORDERED'; me to under go counseling, or random drug tests, but i have agian on my own will.... I have had 2 tests since my last court date, the first one i asked the judge to send me that day, that one came out good. Still traces , but at lower levels than the previous. Then i JUST NOW '; TODAY'; got the results of my second one.... AND i know alot of you like to judge , BUT I HAVE NOT TOUCHED A SINGLE DRUG , EXEPT FOR MY PRESCRIPTIONS, since prior to my last screening, So ive been clean now for about 7-8 weeeks. My kids are too impoPlease help,,,, I have court tomorrow for a divorce/custody case , just found out drug test results @ 4:45pm?
As harsh as it sounds.. if you're taking perscription drugs.. that are mind altering.. then I don't think you'll be capable of caring for your children properly.. personally speaking.

I also don't think a judge would just take your custody away.. if everything was as you described.

If I were you.. fix yourself.. get off the perscription drugs.. find other ways to manage the pain.. and then try for 50/50 custody. Please help,,,, I have court tomorrow for a divorce/custody case , just found out drug test results @ 4:45pm?
I'd be interested in hearing the other side to this story, as they say there's 2 sides to every story. Usually there's a reason the kids are given to the father cause even in this day and age courts are still partial to the mother getting custody, so if it goes the other way there's usually a very good reason.. Also why does the guys mother always get the bad rap just for trying to help her son and the grandchildren, when the womans mother is doing the same thing, seems like a double standard there to. My advice would be to get yourself straightened out and not put the kids in the middle and take some responsibility for your own actions instead of putting blame on everyone else.
i would make sure i told the judge all that..make sure to let him know hes not letting you see them and that they get in trouble if they talk to you on the phone.. and make sure you can show your clean.. if it dont happen yet this time keep trying cause as long as your trying and proving yourself you might get them back someday.. just be honest to the judge.. good luck
Your clean tests and willingness to get them and to stay clean are very important. It does take a few years to be completely clean. Consider taking something called chlorella from the health food store... it nabs toxins and sends them out of your body... and adds oxygen to your blood.

Your ability to show that you can provide a stable home life and that you have a job means a lot, too. Take your paycheck stubs and a bank statement if you think that will help. Even better if you can show a reference letter from your boss that you are a good employee.

The problem here is that your ex has his family involved and running interference on his behalf. If the ex hires the psychologist, the psychologist will tell the court what the ex wants him to... a fact of life.

You are the mother of these children and should have custody.
    Where is your attorney??

Does the state of texas pay for DNA testing in a child support case?

Not usually. However, if the father is challenging paternity and is eligible for waiver of fees or court-appointed legal aide, the state may then pay for it. You have to file an affidavit of indingency with the court, make a motion, and have the judge specifically order the fees waived. This can be done before any proceeding to determine paternity.Does the state of texas pay for DNA testing in a child support case?
Not unless it has to do with states evidence, etc. Otherwise it is up to the individual to incur costs. For instance proof of paternity.

I'm doing a case study for science about genetic testing but I'm not quite sure to write in my introduction?

It's about genetic testing on embryos and I need some pointers on what I can write about. Please help!I'm doing a case study for science about genetic testing but I'm not quite sure to write in my introduction?
talk about the morals and ethics

like , how the mother would see it as a benefit

but other people are against it because it is morally wrong and the embryo can be classed as a life.

Therefore, you can bring human rights into it. Like how the embryo has it's own rights and it is wrong to treat it in such a way etc,

    Hope this helps.

  • If science developed a test for the ';gay gene'; in utero, would Christians be against abortion in that case?

Not that there has ever been a gay gene found, in fact much research seems to indicate a hormonal balance in the womb has something to do with it.

Still, if you are totally against homosexuality, what would you do if you *knew* that your unborn child would be gay?If science developed a test for the ';gay gene'; in utero, would Christians be against abortion in that case?
Isn't that the scariest thought ever? Mass abortions due to what would ultimately be their lifestyle choice?

    But to be noted, not enough people with the ';gay gene'; are homosexual for scientists to actually declare it a ';gay'; test any time soon. Plenty of heterosexuals also have the ';gay gene.'; Not all homosexuals have the ';gay gene.';

Most of my homosexual friends are terrified of people trying to make pills or give abortions for those with children that are likely to be homosexual later on.If science developed a test for the ';gay gene'; in utero, would Christians be against abortion in that case?
Of course I would love him whether or not he was homosexual (not gay). I would also teach him the difference between who he was and what he did.

The homosexual ACT is what is offensive to God, not the person. That much is a choice.

    God bless!
    keep the child
I would abort a pregnancy if ultrasound showed something to soon be nonviable, such as an anacephalic fetus. And only that!
1991 test by gay biologist came up with that theory. Disproven in 1999 by Ottawa University and announced in ABC news.

But do what you want, most of it is culutural indoctrination, absent or violent father.
You are wrong. Several genes have been found to be implcated in homosexuality, but it is definitely not a single gene phenomenon and it is definitely not deterministic.

Given the complex interactions between genes (there are known to be about only 1/10th the genes present in the human genome necessary to express all an individuals characterstics - the rest comes from gene interactions) then ridding the race of four or five ';risk'; genes could be a disaster. We cannot predit what it would cause - maybe it would make all men murdering psychopaths, and maye it would wipe out religious suceptibility - who knows.
I'm not against homosexual acts any more than I am against other sin, including my own. Would you abort everyone, since all are sinners?? Furthermore, even if the disorder did have a genetic cause, the disorder itself is not sin. A person who has some trait that causes temptations toward certain kinds of sin still has the moral responsibility to resist temptation, just like anyone else. Homosexual tendencies are not sinful. Homosexual acts are.
I think they should not bcz it is against humanity and not only one gene is responsible to represent the sexuality of the person.

it depends on the environment( i suppose)

thats why i can see there are far more less people homosexual in asia (as the chiildrens dont know this as an option ).
How could they then say it was a sin, because that would be the same as saying having blue eyes is a sin, because they are to do with genes.

What case are you for/against animal testing?

It continues to be a strange practice in my mind; I thought by now we would have advanced chemistry beyond that dependence. Cold run experiments on humans continues to be unconscionable, but the free will criterion allows the possibility. You can be payed to risk your life. What case are you for/against animal testing?
Animal Testing cannot be totally banned.Clinical trials are necessary before new medicines are tried on human beings.Perhaps less harmful medicines, with known contents can be tried on volunteers. If you do want not touch any animal, you have to depends on vegetables and cereals. The world price of food grains are already increasing.Total love for animals may lead world food/economic crisis.Another option is going for herbal medicines, which will lead to collapse of modern pharmaceutical industry-another economic problem. What case are you for/against animal testing?
Totally against it. There are other ways of testing new drugs other than this cruel and barbaric treatment of animals. Before anybody says you would take the drugs if you were dying, no I wouldn't. If penicillin had been tested on guinea pigs they would have died as they are allergic to it so it would never have come on to the market. Proves the point I think
I am for Animal Testing for new medicine. I do not wear make up as I am allergic to all make up so I do not care for it. But I think human life is saved by medicine and I am a member of Animal Rescue and yet believe animals should be used first for medicine testing.
I am strictly against animal testing, in terms of both cosmetic and medical

research because for one animals have a different way of reacting to chemicals, secondly animals cannot speak out for the pain that they endure.
I think that for medical reasons, we should have animal testing. However, like Paine said we could use death row inmates, because if their crime was so horrific,,,

However, cosmetic testing on animals is bad and unnescessary.
As somebody who wouldn't have lived if it wasn't for animal testing I'd have to say for. I suppose there's different degrees of it where I'm against it eg testing on animals for cosmetics.
I think instead of animal testing we should test on the people who are sent to the consiquence of ';death row'; therefore it is more effective and they are going to die anyway.

Case study - ethics in education - test anxiety?

I've given this task to somewhat ethically decide the best solution for certain questions. Here is the link to the case study :

Also, there is an additional question that goes like this:

What do you think you should do as a teacher? Utilize all the characteristics of a good teacher as well as the codes of ethics that you have learned. (I think i can figure this out, but if you guys have better recommendations, that will be a great help)

Is it leagal in ohio to give a sobriety test to a minor w/o parents permission. Not a driver in this case?

my daughter was stopped while walking down the street with some freinds, she was put in a police car and taken to the station, there she was made to submit to a sobriety test. we were not notified until after the fact. She is 16. was this action legal under ohio law?Is it leagal in ohio to give a sobriety test to a minor w/o parents permission. Not a driver in this case?
yes they only need you there if they question her in suspicion of a crime. Is it leagal in ohio to give a sobriety test to a minor w/o parents permission. Not a driver in this case?
If they have reason to suspect the minor has been drinking (i.e. the driver was drunk, there was alcohol in the vehicle, the smell of alcohol, the appearance of intoxication. . .), that is called ';probibal cause';. With probibal cause, they have the right to search without permission.

If they had no reason to suspect there was drinking, then they can't do a search. They would need permission from the parents to do a breath test. But good luck proving the cops didn't suspect drinking. . .
Yes they may, if she was questioned she would have had to have had her rights read to her ( but only if questined)

But parents do not have to be present at questioning and only notified if arrested.

She was strongly suggested, but she could not be forced to take the test, she could have been lied to, or tricked, but not forced.
Of course its legal, she is a minor and the last time i checked minors aren't allowed to consume alcohol, you also could feel the consequences since she is your responsibility while she is a minor
Since it is a crime for a minor to posses or consume alcohol, a police officer who has probable cause to suspect that she has illegally consumed alcohol may administer a sobriety test. She doesn't need to be over the limit for driving, she just needs to have a positive test result that cannot be explained by medical reasons. Most states set the alcohol limit for drivers under 21 at .01 or .02, well below the adult standard of .08.

The only question to be addressed is did the officer have probable cause? Any of the standard clues would be valid: Stumbling gait, slurred speech, odor of alcoholic beverages on the breath, drinking from a container wrapped in a paper bag, open consumption of alcohol, walking out of a bar (for a minor), being in the company of persons previously convicted of that offense who are in possession of alcohol, etc. would all probably meet the test.

Regardless of what your daughter or her friends might have said, a police officer would not just single her out from a group of people and run her in for a sobriety test. He saw something that gave rise to probable cause or he would not have taken her into custody.

Some states may require the parents to be present during questioning for certain crimes, but taking a sample for ascertaining alcohol consumption and sobriety is not questioning a suspect under the law and is not protected under the 5th Ammendment.

In many states, a conviction for minor in posession (consumption) of alcohol will mean the minor's driving priviledge will be revoked until they turn 21.
Don't get into a twist as I'm sure that she had nothing to hide.
Yes. And if she blows positive, YOU are in trouble as well as she.

Quite literally, your daughter is being invesitigated for a serious criminal act, due to probable cause by the officer.
    1. I don't know of any state that requires a parent's permission to administer a sobriety test.

    2. You probably need to consider what Ohio's drunk in public statutes law says about why she was picked up. This would be especially relevant if that state as adoped some kind of zero tolerance law regarding minor's drinking.

Rather than worring about whether the police took appropriate action, perhaps you should ponder what the parent's liability is if your daughter is found guilty of a violation.
I can't find the answer right now. But I believe that this would fall under what's called exigent circumstances. In an alcohol related incident, the officer has a set window of time to conduct the breathalizer. Since the evidence in this case if ';volatile'; and will disappear over time, he must get the evidence without a warrant or the parents permission since obtaining permission or a warrant would take too much time.

It's kinda the same reason a police officer can chase a suspect into a home and arrest them there. They don't need to stop at the door and get a warrant if they witnessed the suspect enter the home and the suspect poses a threat.

Another example would be if an officer asks a suspect a question like, ';Where's the gun'; during an arrest. The officer must make the scene safe first. He does not have to arrest the supsect, then read them Miranda before he can ask such a question if the situation is dangerous. Such as the presence of a weapon in a crowded grocery store.

    These are all exigent circumstances.

First they have to have some proof and can get into trouble for saying the person uses drugs if they prove they don't. but if the judge is a hard-liner he/she will order a test. 9 out of ten times a test is ordered. my father tried that with my mom and the judge ordered test that day.If accused of drug use in custody case do i have to take drug test....?
Yes you will and it will not be just a urine sample. They do hair follicle tests.
    I certainly hope so!

Can I get my California misdemeanor case thrown out? Drug test hasn't come back, its been over 60 days?

From what I've ready, 60 days is the requirement. I'm pretty sure it has been 60 days, but when does this 60 days start?

I didn't think to ask my public defender, and I'm wondering if I should go back and try to talk with her about it.Can I get my California misdemeanor case thrown out? Drug test hasn't come back, its been over 60 days?
Penal Code section 1382 provides that trial in a misdemeanor case for a defendant not in custody has to commence within 45 days of the defendant's arraignment or entry of a plea, whichever is later. However, that time limit can be exceeded with consent or for good cause. If evidence is still missing, it is very likely that, if this is beyond that 45 day period, there has been a finding of consent or good cause for the delay.

ADD: You can be convicted of violating H%26amp;S 11550 without a blood test, just on the symptoms reported by a police officer. If you told your attorney that you were under the influence of prescribed medication, it is likely that your attorney would want the test results to prove your innocence. If you told your attorney that the test would show the use of illegal drugs, then she might wish to insist upon your statutory speedy trial right. Again, that time limit dates from the day you plead not guilty, and is 45 days.

  • In 22 weeks pregnancy all Ig G titres of torch test are raised. As a doctor how do I manage the case ?

Torch is agroup of Toxoplasma gondii,Rubella,Cytomegalo virus%26amp;herpes simplex virus infections,,which if infect during early pregnancy may lead to fetal malformations, growth retardation or fetal death. Because of cost factor many a times only few selective (IgM/IgG) titres are tested. When IgG s are raised should I ask for IgMs or repeat IgGs ? Also the patient had two abortions before. they are keen on continuing this pregnancy. tellme more about management of such casesIn 22 weeks pregnancy all Ig G titres of torch test are raised. As a doctor how do I manage the case ?
I'm no expert on obstetrics, but IgG antibodies to each of the TORCH organisms would indicate past infection (or immunization in the case of rubella) to each of these, and IgG antibodies can be expected to persist lifelong. All the TORCH organisms are common, it wouldn't be surprising for many women to have had the full hand at some time in the past. I would be doing IgM antibodies to check whether any of these infections are current or recent.

The pathologist at the lab who did the test can also advise: I find them a fount of useful help in interpreting test results.

If the IgG titres are higher than titres done earlier in the pregnancy, I would contact the pathologist for an opinion on whether such a rising titre is significant.

Is this smart right after I did a drug test for my job, I went and had one done on my own in case they ?

tried to sabotage the one they gave me to set me up further and make me look like a drug addict, so if they did do that it will back fire greatly and I will have great proof on many levels, what do you thinkIs this smart right after I did a drug test for my job, I went and had one done on my own in case they ?
Smart? Why wouldn't it be (or for that matter, why would it be?)

Paranoid? Yes. A problem? No.Is this smart right after I did a drug test for my job, I went and had one done on my own in case they ?
A waste. No matter what the result is, you are probably ';at will'; employment, which means you can quit or they can fire you at any time, for any reason. Why would they go through the trouble to set you up? They can just cite something like ';poor productivity'; and fire you.

Let's say the test they gave you was positive, and the test you took on your own was negative. Unless you got it done at the same clinic, they could easily say that the test you paid for was not as sensitive as the one they gave you.

';At will'; employment is the most common type of employment in America. Like I said, it means that you can quit at any time, and they can fire you at any time. The other main type of employment is anything with a contract (including union jobs). A contract may stipulate that you will work from X date until Y date, or if you are in a union, they will supposedly back you up if your employer were to try to fire you.

Because you are probably at will, your employer can let you go for any reason. Surely you haven't been 100% perfect at your job, and if they really wanted to fire you, they could find some reason without resorting to tampering with drug test results.

Which leads to my next point: There is no way they could have sabotaged your test, unless they just had you pee in a cup in the office and said they would take care of everything else. If they sent you to a clinic, then only clinic employees had access to your test. If it all gets tested by the same people, as you say, then why would one test fail?

And it really doesn't matter if the test you paid for is ';better.'; If the company has a policy to get all drug tests done at a certain clinic, then they aren't going to bother with the results you got from another clinic. And don't count on your clinic giving you any support in proving that their methods are superior - why would they?

The likelihood of someone at your work and someone involved in your drug test both being in the same frat, and conspiring to get you fired, is preposterously low. Again, they can fire you for any reason. If you are a good employee, they won't fire you.

I strongly suggest that you seek out psychiatric help. Everything you are saying is reminding me of someone I personally knew who had a severe mental illness.
A waste of time and money. Should the original test be tainted, there is a second sample, that you initialed, that you can pay to have tested. Your money will be refunded if it comes up clean. Tests are taken, sealed and sent out for testing after being supervised by you and initialed.
i think it was a waste. yours probably wouldn't hold up anyway because you could have had someone else take the test for you

DUI the other day...No rights read, breathalizer, or blood test done...Have a case?...?

So early Saturday morning I was sitting in a parking lot, car was on. Cop pulled me out, barely failed the field test and yes I started to mouth off a little. There were open bottles in the car. Ummm, I received no breathalizer or blood test at the jail. No rights were read upon arrest...*Not sure if they have to anyways for a DUI or what that could mean* ....Should I fight this and if so and I still lose will the sentence be the same or will they be pissed I tried to fight it?DUI the other day...No rights read, breathalizer, or blood test done...Have a case?...?
Where do all you people get your info? MTV? YOU DO NOT HAVE TO HAVE YOUR RIGHTS READ TO YOU IN ALL CASES, PERIOD Miranda only comes into play when you are arrested AND they want to question you post-arrest. And NO, THEY WILL NOT ';THROW OUT'; THE CASE IF THE POLICE DIDN'T READ YOU YOUR RIGHTS, even when they should have. The point of this forum is to give information to people who are asking for help, not to give you TV-based opinion.

As for your case, what training have you had to judge whether you ';passed'; or ';barely'; failed FST's? None. FST's are not pass or fail, they are a means to see if impairment exists and at what level. The officer's training and experience is what determines the results of FST's.

You seem to get the gravity of what you did, which is a good thing. I hate to tell you you don't have much of a chance in court if the officer documented everything well. If this is your first and you choose to plead guilty, let the judge know that you realize it was a mistake.

Bottom line, being pulled over and arrest for DUI is a lot better then getting into a wreck and killing some 3 year old.DUI the other day...No rights read, breathalizer, or blood test done...Have a case?...?
They do have to read you your rights if you are arrested. There is no need for a breathalizer or blood test because you had open containers in your car. Fighting it will require an attorney and DUI attorneys are not real cheap. You can try fighting it on your own, but that is generally considered foolish. The ounishment will be the same whether you do decide to fight it or not.
Contact a DWI lawyer. Those slime balls can get you off the hook even if you were on video sometimes. They will not be pissed if you try to fight it, that's paid court overtime for the cop. Each state is different on their laws so I can't tell you if they needed to read rights, usually it's a statutory warning about right to refuse tests, etc not Miranda rights. Most likely you were on video at the station so just get the lawyer and don't drink and drive again.
They don't have to read rights anymore, the law was changed a few years back. You are probably hosed as far as a conviction, however, due to the weak nature of the evidence (no, blood or breath) you could probably get an attorney to lower the penalties and maybe even get the case dismissed if you are very lucky
you might have a case if you can prove you weren't read your rights. as far as the whole dui thing it depends on your state laws. i know in pa if you are even found in the drivers seat with the engine off and the car parked that can book you for a dui, my friend is a cop near pittsburgh and he told me that. so you'd best see an attorney and see what can be done.
Were you arrested for DUI? Then get a good lawyer and tell him you were not read your rights. If they can prove you failed the field sobriety test, you may be doomed. They could probably drop the open liquor charge if this was your first offense. I hope you learned a lesson!
My friend got a DUI years ago and the lawyers find out and start soliciting you. So pick one and see if you can get off. Next time don't mouth off to the cops you jacka@@. You probably deserve to be in jail but it is possible to get off. I hope it costs you a lot of money!
The only time miranda needs to be read to you is during custodial interrogation. in other words, no you have no case. The officer did everything legally
    Simple:

Yes, you have a case as long as you had nothing to drink.

Also, how would you know if rights were read if you were mouthing off at the same time?
Take it to one of them cheesy outfits that fight traffic cases. Glad to hear the oinks didnt Taser you with Thomas A. Swift's Electric Rifle. Good Luck from the beautiful Dominion of Canada.
were you resisting arrest? Did you incriminate yourself by admitting anything................... get a police report of what happened and then ';get an attorney'; this can be dismissed caused certain things sound shady here... good luck
fight it, but get a lawyer, it will be cheaper in the long run. Oh and dont wear a beer logo t-shirt to court like my family members do! it wont help
Get a lawyer now! But besides all that ';open bottles?'; You must've been three sheets to the wind. At lease you weren't driving. But it sounds like a bad scene.
    http://forum.freeadvice.com/

I'd check on that forum, they provide good help.
Call an attorney. THey can best advise you. We are not attorneys.
i believe they have to read you your rights, but look up like citizens rights on google or yahoo or ask.com

sounds like you werent treated fairly
Do as the first one said. Get a DUI lawyer. They will know what is what in your local jurisdiction.
    www.duihelpnow.info
If you were not Mirandized there is no case.
Contact an attorney that specializes in DUIs.
    depend ending on the state
yes u have a case because it is the law for an aresting officer to read u ur rights
Alot depends on your state law. In California, NO, you do not have to be read your rights when being arrested. This only applies if the officer is going to question you AFTER you are arrested. Everything else involved in a DUI investigation is simply that, an investigation and open to questioning without rights being read.

As far as fighting it, hope you have alot of money! To hire a DUI attorney will definately cost you.
I am a police officer...So I will let you know that they did not have to read you your rights...there are situations in which it is required but this is not one! They are only required to tell you your miranda rights during a interrogation.

as for the breathalizer or blood test....All the officer will need to prove is your impairment...all the tests do is add to the Probable Cause that you were under the influence....If the officer believes that he already had enough PC to make the arrest the tests are not needed.

Should you fight it? The chances are you are gonna loose either way. But if you hire a great lawyer, you can get the charge dropped to a lesser offense...But then you are talking a chunk of change...if this is your first offense...probation and Community Service...and go on about your way. If this is not your first offense...GET THAT PRICEY LAWYER, or YOU WILL LOSE YOUR LICENSE!
Get an attorney - it will cost you (and it should), but you may be able to beat it, or get the charge reduced. You are going to be paying out a lot of money anyway, so you might as well give it your best shot. And yes, the police have to read your your rights (no matter what) if they arrest you! Bad faux pas on their part, and yes it could cost ';them'; the DUI conviction, and get you off. ';They'; really don't need the breathalyzer if you fail the field test (I think) especially if it is on video, but that depends on the field test used.

Who cares if ';they'; will be pissed if you try to fight it? It's your future we're talking about, not theirs'. If you think you have problems now, wait until this DUI charge is finalized, and on your record. Every time a copy runs your plate, this DUI will pop up on the computer in his patrol car, and he will pull you over and check you out (you will be like a cheep watch, getting stopped every 5 minutes), all because you were foolish enough to be sitting in a parked car with the motor running (yes, that is DWI). And just wait until you find out what auto insurance is going to cost you now!

The bottom line, is that if you are drunk, and are sitting in a parked car, make sure that the keys are in your pocket (or the glove box), you are sitting in the passenger (or back seat), and the keys are not in the ignition with the motor running! CUT BACK ON YOUR DRINKING, OR IF YOU MUST DRINK, STAY AT HOME!

  • Has anyone had to undergo a hair follicle drug test for a custody case? How far did it go back?

I have tried to figure out online how far a hair follicle drug screening can go back to detect usage. I seem to be getting multiple answers for this on the internet, some places say 3 months, some say 6 months, so what is it? Please only answer with factual information that you have gathered from your own personal experience, I don't need answers that you got off the internet, I have already thoroughly investigated the internet. THANKS!Has anyone had to undergo a hair follicle drug test for a custody case? How far did it go back?
Drug screening is standard practice in pre-employment assessment, with hair follicle testing being the most common tool. Our company was told, by the medical vendor who conducts drug screening on our behalf, that the test covers 90 days.

Hope that info is helpful.Has anyone had to undergo a hair follicle drug test for a custody case? How far did it go back?
Hair tests actually go back years. The drugs can show in the follicle for about 3-6 months (so what you are reading is semi accurate) depending on the specific drugs being used. However, they can see the drugs you have done for as long as the hair is. If the hair is long enough that it was growing 3 years ago, it could show drug use from 3 years ago.

The problem with hair testing, is that its not completely accurate. They can only make an estimate of when the drug use was, due to differences in hair growth rates from person to person.
i didnt have 1 but i came very close to getting one about 6 years ago and the judge had told me that they would be able to see wut drus i have taken for the last 6 months
